1. Overview
The bioPRO™ Certification Program confirms that an installer has successfully completed training in the fundamentals of bioaqualife® technology, product handling, and recommended best-practice installation methods. Certification signifies only that the installer has completed such training. It does not constitute a guarantee, warranty, or endorsement by bioaqualife® regarding the quality, workmanship, performance, safety, compliance, or results of any installation, service, or product application.
2. Independent Contractor Status
All individuals or entities listed on the bioPRO™ platform operate as independent contractors. They are not employees, agents, partners, affiliates, or representatives of bioaqualife®. bioaqualife® does not supervise, control, or direct the manner or means by which installers or third parties perform their work.
3. Limitation of Liability
bioaqualife®, including its affiliates, shareholders, officers, directors, employees, and agents, expressly disclaims all liability for any of the following:
Installation-related damage, defect, failure, or loss;
Acts, omissions, errors, negligence, or misconduct by installers, distributors, dealers, or other third parties;
Representations, statements, or claims made by installers or third parties regarding bioaqualife® products or services;
Misuse, alteration, misapplication, or modification of bioaqualife® products after delivery.
4. Transfer of Ownership and Responsibility
Ownership, custody, and all risks associated with bioaqualife® products transfer immediately upon delivery to the distributor, dealer, or installer. From that moment, all liability, responsibility, and obligations related to product handling, storage, installation, and outcomes rest solely with the receiving or performing party.
5. Customer Acknowledgment
By engaging or contracting with any certified bioPRO™ installer or other third-party contractor, the customer acknowledges and agrees that:
bioaqualife® bears no responsibility or liability of any kind for installation or related services, and all risks, losses, claims, and disputes are strictly between the customer and the installer or contractor.
6. Geographic Scope and Jurisdiction
This disclaimer applies to all uses of bioaqualife® products and services within the United States (including all 50 states, the District of Columbia, Puerto Rico, the U.S. Virgin Islands, and all U.S. territories) and worldwide, to the fullest extent permitted by applicable law. If any portion of this disclaimer is held invalid or unenforceable, the remaining terms shall remain in full force and effect.
7. Governing Law
This disclaimer shall be governed by and construed in accordance with the laws of the State of Rhode Island, USA, without regard to its conflict of law principles.
